Employment Law FAQs

Employers owe a duty of care to employees. If an employer knew (or should have known) that workplace conduct was causing harm, and failed to prevent it, they may be liable. Expert evidence on foreseeability and causation is critical.

Occupational psychologists are best for stress, bullying, and discrimination assessment. Psychiatrists are helpful when diagnosed conditions need medical opinion or medication is involved. Many cases benefit from both.

Experts assess three things:

  • Was the harm foreseeable?
  • Did the employer fall below the standard of care?
  • Is there a clear link between the workplace conduct and the claimant's psychological condition?

They also consider alternative causes.

Assessments work either way, during employment or after departure. The expert will advise on optimal timing for your specific case and any impact on findings.

Costs vary by case complexity and assessment scope. Call 01306 879 975 or complete our enquiry form to learn more. For Legal Aid cases, we work at LAA rates.

Yes, if necessary the expert can be instructed for tribunal attendance. Discuss this with your Client Manager.
